Declaration

You declare that you wish to take part in the online prescribing service. The online consultations are subject to the terms and conditions set out in this agreement.

You undertake that all information provided by you is accurate, complete and up to date. By using our Website, you confirm that you accept these terms and agree to comply with them. If you do not agree to these terms, you must not use our Website.

Medication is prescribed based on the information you provide to our clinicians through assessments on the Website and via web messages, email and telephone. We shall not be liable for any loss or damage arising from services provided or medication prescribed where this results from incorrect, incomplete or misleading information supplied by you.

You agree to inform our clinicians of any side effects of treatment and any other issues arising from treatments provided through the Website.

You agree to inform your GP or other relevant healthcare professional about any medication supplied and advice given to you through the Website.

The clinicians we engage are registered in the United Kingdom with the General Pharmaceutical Council and the General Medical Council and hold the relevant prescriber qualifications. Clinicians are trained in providing remote consultations and issuing prescription medicine online and are individually responsible for the prescriptions they issue.

We shall not be liable for any damages arising from your failure to inform your GP or other healthcare professional about treatment received through the Website.

We shall not be liable for any damages resulting from your failure to follow advice given on the Website.

You acknowledge that the Website does not replace your GP or other healthcare services and that you should seek independent medical advice where appropriate.

You agree to carefully read all product packaging and patient information leaflets supplied with your medication.

While we aim to supply the same brand of medication consistently, stock availability may vary. To avoid disruption to your treatment, we reserve the right to dispense an equivalent generic or alternative brand of the same medication. All alternatives will meet the same quality and safety standards.

If you do not understand any questions within the assessment or any advice provided, you agree to seek clarification from our clinicians before proceeding.

If your medicine appears damaged, incorrectly dispensed or delivery is delayed, you agree to contact us at contact@follicle.uk for advice and resolution.

You authorize private prescriptions issued in your name via the Website to be sent electronically on your behalf to Manchester Chemist LTD (GPhC 9010683) for dispensing and delivery to your nominated address. You are responsible for payment for dispensing and supply of medication, and you authorize us to arrange such payment on your behalf where applicable.

Prescriptions are issued solely at the discretion of the prescriber.

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions shall remain valid and enforceable.


Data Protection & Privacy

You give your consent for information about yourself, your health and your current medications, including information provided during the online consultation, to be processed and shared between our employees, clinicians and relevant healthcare professionals for the purpose of providing medical services to you. This information may be exchanged electronically.

All personal data is processed in accordance with applicable data protection legislation, including the Data Protection Act 2018 and the UK GDPR.

We process your personal data lawfully, fairly and transparently, and only for purposes necessary to provide our services. Appropriate technical and organizational measures are in place to protect your data against unauthorized access, loss, misuse or disclosure.

Regulations require patient identity verification. This may include submission of photographic identification and checks against third-party databases, including credit reference agencies. These checks are conducted as “soft searches” and will not affect your credit rating.


Delivery & Third Parties

We are not responsible for failures or delays caused by third-party delivery providers. You are responsible for providing an accurate delivery address and for accepting delivery of medicines.

Where medicines are delivered to your nominated address, any signature provided at that address or neighboring address shall be deemed proof of receipt. Where a non-signed delivery service is used, confirmation from the delivery provider shall be deemed proof of delivery.


Payments

You are responsible for providing valid payment details. We reserve the right to withhold services where payment details are invalid or expired.

Payments are processed via Stripe on a continuous authority basis, allowing additional charges or refunds where necessary.

To prevent fraud, we may validate your personal information against third-party databases. By accepting these terms, you consent to such checks. This may involve sharing your information with credit reference agencies for identity verification purposes only and will not impact your credit score.


Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

Subject to the above, Follicle Hair Ltd, its directors, employees and affiliates shall not be liable for any indirect or consequential losses arising from use of the Website or its services.


Governing Law

These terms are governed by English law and are subject to the exclusive jurisdiction of the courts of England and Wales.
